General Terms and Conditions Trapeton Summer Bash Festival

1 General Provisions

• The Trapeton Summer Bash Festival is a festival organized by TRAPETON GmbH, hereinafter referred to as the “Organizer.”

• By purchasing a ticket to the festival, the buyer accepts these General Terms and Conditions. The holder of a ticket who has not acquired their ticket through the ticket providers specified by the Organizer, or who has otherwise obtained a ticket, accepts these General Terms and Conditions at the moment they take possession of the ticket.

• Strict compliance with the instructions of the Organizer’s staff is required. Non-compliance will result in expulsion from the festival area without a refund of the ticket price. Civil and criminal proceedings by the Organizer remain reserved.

• The festival area consists of the following separate sections: festival grounds, VIP zone, camping sites, and the festival parking lot. Access to the festival area or individual sections is only granted with a valid ticket during the access times published for the respective category on the Organizer’s website.

• The festival visitor agrees that they will be recorded as part of the audience before, during, and after the festival in image, sound, and video recordings. These recordings may be used and exploited commercially by the Organizer and/or third parties without compensation. The festival visitor expressly and irrevocably waives any claims to their personality rights in this regard.

• Festival visitors must be at least 6 years old. Admission for those under 16 is only allowed when accompanied by a legal guardian or with written consent from a legal guardian. The Organizer declines any responsibility and/or liability in the case of non-compliance.

2 Program

• The Organizer has no influence on the design and content of the artists’ performances. The Organizer assumes no liability in this regard.

• The Organizer reserves the right to change the content and/or program of the festival at any time and without prior notice.

3 Noise Emissions

• Due to the volume at concerts, there is a risk of potential hearing and health damage. Earplugs will be provided at the entrances to and at specific locations within the festival area.

• The Organizer declines any responsibility for any hearing or health damage.

4 Security

• The Organizer’s security service conducts security and admission checks at all official entrances to and along the festival area and throughout the festival’s duration.

• The security service carries out random bag checks and body searches in consultation/cooperation with local police authorities.

• The right to deny festival visitors entry to the festival area for important reasons or to expel them from the festival area remains reserved. If the festival visitor is not at fault, the Organizer may, at its discretion, refund the ticket price. Non-compliance with these General Terms and Conditions constitutes an important reason.

5 Access to and Behavior in the Festival Area

5.1 TRAFFIC

• Parking on access roads to the festival area and within the festival area (excluding festival parking lots) is strictly prohibited.

• Vehicles parked on access roads or not in the festival parking lot will be towed without notice and at the owner’s expense. The vehicle owner will be charged and must bear all costs as soon as the towing service is ordered.

• Parking of vehicles is at the owner’s risk.

• Public transportation should be used whenever possible.

5.2 ADMISSION

5.3 RECORDINGS

• Taking pictures, sound, film, and video recordings of the artists performing at the festival is not allowed. Recordings for private use are generally permitted.

• The commercial use and exploitation of images, sound, film, and video recordings of the artists performing at the festival, festival visitors, or the festival infrastructure is prohibited.

• Violations will be pursued under civil and criminal law.

5.4 ADDITIONAL RULES

• Prohibited items and animals on the festival grounds include: – Sun and rain umbrellas, as well as (flag) poles – All firearms, spray, stabbing, striking, and cutting weapons, and other items considered dangerous, particularly pocket knives – Cameras with digital or analog single-lens reflex cameras with/without interchangeable lenses, film and video cameras, and audio recording devices – Selfie and GoPro sticks, etc. – Drones and other flight-capable devices, with or without cameras – Rollerblades, skateboards, scooters, roller skates, bicycles, strollers, etc. – Glass – Pyrotechnic items, firecrackers, dry ice – Straw (bales) and similar products – Household items, sofas, etc. – Animals

6 TICKETS

• Tickets can only be purchased through the ticket providers specified by the Organizer.

6.1 NO RETURN OR REFUND CLAIM

• In no case is there a right to return the ticket or a refund claim on the ticket price.

• Festival visitors acknowledge that the festival lineup is subject to change at any time, even at short notice, whether performance times are shifted or an artist does not perform at all. These and similar circumstances do not entitle visitors to a ticket return or refund claim on the ticket price.

6.2 RESALE OF TICKETS

• Purchasing tickets for the purpose of reselling is prohibited. The Organizer will conduct checks and may block and invalidate tickets acquired for resale purposes. Civil and criminal legal actions are reserved.

7 LIABILITY

• To the extent legally permissible, any liability of the Organizer for its own conduct and that of its assistants is excluded. The Organizer and its assistants are not liable for any bodily or property damage caused to festival visitors by third parties (e.g., booth operators).

• The Organizer is not responsible for lost or stolen items. Lost items will be handed over to the TRAPETON lost property office after the festival.

8 FINAL PROVISIONS

• If the festival must be canceled or postponed due to force majeure (e.g., war, death or illness of an artist, severe weather, disasters, unrest, terrorism threat or warning, epidemics, pandemics, official prohibition, or uncredited non-permission of the festival, etc.), there is neither a right to return the ticket nor to a refund of the ticket price. Instead, the ticket can only be exchanged for a ticket to the next edition of the festival. In exceptional cases, at the Organizer’s discretion and on a case-by-case basis, the ticket price may be refunded, minus a handling fee of 10% of the purchase price (maximum handling fee CHF 50.00). There is no entitlement to this.

• If the festival must be interrupted or terminated due to force majeure, there is neither a right to return the ticket, a refund of the ticket price, nor an exchange for the next edition of the festival. A festival interruption is any temporary interruption of the festival occurring after the festival opening (e.g., due to severe weather). A festival termination is any termination of the festival occurring after the festival opening (e.g., due to official prohibition).

• Changes to these General Terms and Conditions must be in writing.

• No side agreements exist.

• The Organizer reserves the right to change these General Terms and Conditions at any time. Changes are deemed accepted if not objected to within 30 days of publication.

• Swiss law exclusively applies to these General Terms and Conditions, excluding its conflict of laws rules and the Vienna Sales Convention. Aarau, Switzerland, is agreed upon as the exclusive jurisdiction for all disputes.
